HOW TO CONTROL SEXUALLY ORIENTED BUSINESSES

What can a community do to protect itself against sexually oriented businesses such as strip clubs, porn shops, and the like? This is a question often asked by city council members, planning board members and citizen leaders. The answer is, "a lot!" While the U.S. Supreme Court has ruled that municipalities may not completely exclude such businesses, zoning and licensing laws may be utilized to control them. Such businesses may be zoned away from residential areas, churches, schools, playgrounds, etc. Strict licensing regulations may be imposed, prohibiting nudity and sexual touching, requiring background checks for employees to make sure that prostitutes and sexual predators are not employed at the businesses. Sexual acts and so-called lap dancing may be prohibited. Communities that pass good zoning and licensing ordinances often find that sex businesses will stay away and go elsewhere where they are unregulated. So if you want a clean, safe community, make sure that you are prepared. Contact Pat Trueman for help.

If a community is not prepared and receives a permit application from a sexually oriented business, there is still much that can be done. Pat can help your community with the intricacies of U.S. Constitutional law and get the job done right. For a primer on what can be done with sexually oriented businesses, click here..

The Alliance Defense Fund provides excellent legal materials to help communities through its Community Defense Counsel web site. Pat serves as special counsel to ADF. Materials may need to be updated but are free of charge. Click on "SOB Manual." All aspects of federal constitutional law regarding regulation of sexually oriented businesses are explained in this helpful manual. There is also a Sample Sexually Oriented Business Ordinance in Appendix A. See also App. D: Summaries of Secondary Effects Reports and App. F: Report of the MN Attorney General's Working Group on Regulation of SOBs for reports of the serious harmful secondary effects of sexually oriented businesses such as rape, prostitution, decrease in neighboring property values.

Pat can work with and testify before city, township, or county councils on all aspects of sexually oriented businesses. He will draft a constitutional ordinance to control these businesses. Because of his background, as chief of the U.S. Department of Justice Child Exploitation and Obscenity Section, Pat can also work with your local prosecutor to bring an obscenity case against pornography shops. He also has extensive experience in training law enforcement on human sexual trafficking, and child exploitation. He is quoted often in the national media on these and related issues.
