HOW
TO CONTROL SEXUALLY ORIENTED BUSINESSES
What can a community do to protect itself against sexually oriented
businesses such as strip clubs, porn shops, and the like? This is a
question often asked by city council members, planning board members
and citizen leaders. The answer is, "a lot!" While the U.S.
Supreme Court has ruled that municipalities may not completely exclude
such businesses, zoning and licensing laws may be utilized to control
them. Such businesses may be zoned away from residential areas, churches,
schools, playgrounds, etc. Strict licensing regulations may be imposed,
prohibiting nudity and sexual touching, requiring background checks
for employees to make sure that prostitutes and sexual predators are
not employed at the businesses. Sexual acts and so-called lap dancing
may be prohibited. Communities that pass good zoning and licensing ordinances
often find that sex businesses will stay away and go elsewhere where
they are unregulated. So if you want a clean, safe community, make sure
